Overview

 The Restatement (Third) of Unfair Competition serves as a valuable source of modern trade secret law. It follows the UTSA approach but also provides statements of the law that are more comprehensive and provides useful comments for understanding various situations and meanings behind the law. The Restatement is a useful tool for interpreting both the UTSA and DTSA .

One court commented that this Restatement has already “supplanted” Restatement of Torts §757 on trade secret law issues. Briefing.com v. Jones, 126 P.3d 928, 931 (Wyo. 2006). However, courts have cited its trade secret provisions only about 200 times in the last decade—much less frequently than the Restatement of Torts section. --Understanding Trade Secrets, Chapter 1, Footnote 31.
